The Terms of Service that will be exposed below represents a binding legal contract in which, you, as a user of our site or as a guest of one of our properties; and Hospedify, as the provider of these services; agree to comply with those detailed here for the use of this website.
In the case of our corporative figure, that is, Hospedify, it may also be represented in the forms of "we" or "our", applying these terms to Hospedify in the fields, descriptions or examples that apply or are used.
This platform works in the modality of an online site in which its users can search, consult and realize the reservation of the properties displayed in the form of advertisements.
Once a reservation is made explicitly and in writing through the contracting of a property and/or Experience offered by us, you as a user will be considered a guest and will be subject to the rules that apply to you.
As Hospedify is part of the contracts entered into directly, we request at all times complete sincerity and clarity in the expression of the users of the page, interested in properties for the purpose of reserving or Guests, as well as full respect for the rules and contracts.
In our role as hosts and providers we are obliged to offer a quality service at all times, and therefore we accept the responsibility of understanding and complying with all laws, rules, regulations and contracts with third parties that apply to the Host Services that we will offer our guests, and for this reason we ask you to fully comply with these points.

Terms for Guests and users of this website
1. About the Search and Reservation processes.
1.1- About the Searches: From certain specific criteria, such as the capacity of guests of the property, dates or price; As a user, you can search for properties on this site and request information or reserve the one that best suits your needs. Some properties may be more relevant than others based on enabling factors, such as previous reviews, cancellation history, or popularity of the properties.
1.2- Regarding reservations: When making the reservation of an Ad, you agree to make the payment for said reservation and cover in full the expenses that are included in the amount of the reservation, these may be taxes (in cases that applies), applicable rates for services or offline rates, Points that will make up the Total Price. These points will be clearly exposed to you on our part during the consultation process, and payment of the Total Price will only be required once you have received confirmation of the reservation and have accepted the contracting of the property for your stay. Once this confirmation has been made, you must also be responsible for compliance with all the terms of the reservation, which include the specific rules of the property, the cancellation policies, the standards and requirements clearly requested in the Advertisement and the payment of your reservation. Likewise, it is expected that you comply with your responsibility to know what is stated in these Terms and Conditions of Use, the aforementioned policies, standards and rules and the reservation requirements before reserving an Ad. Not knowing these points by deciding to omit or ignore these Terms and Conditions does not exempt from compliance with all the points stated above.
1.3- Regarding the rights of the guest when making a reservation: An Accommodation reservation constitutes the license granted to the Guest to enter the property, occupy it and use it during the time established in the reservation contract. We, in our role as Hosts, reserve the right to enter the property in the following cases:
• If it is strictly necessary;
• If requested by the guest;
• If it is allowed by the contract;
• If the guest has not left the property once the reservation time established in the contract has ended.
If you incur this last point, We will be completely free and right to kindly urge you to leave immediately, using legal means if necessary and/or applying a penalty for prolonged stay. If, on the other hand, you have communicated your wish to extend your stay and said wish does not affect a possible subsequent reservation, the adjustment to the contract will be made by adding to the Total Price the amount for the additional days, an amount that must be paid as soon as possible.
1.4- About additional guests: The entry without authorization from us of additional people to those detailed in the accommodation reservation contract is prohibited. Additional people will only be able to access the maximum capacity of the villa or the figure mentioned in the contract under the notification and authorization of Hospedify and once the amount per additional person that corresponds is paid in case of approval of this situation.
1.5- Regarding the reservation of Additional Experiences and Services: Additional experiences and services are activities or benefits outside the usual rate that must be requested, scheduled and paid for by you and the guests who accompany you and wish to enjoy it. You have the obligation to attend said service if you have requested it and you must previously confirm that all those interested in this activity meet the legal requirements of age and health condition required for the experiences or activities that they request. In addition, you are obliged to inform Hospedify of any physical or medical condition that any of the members of the group may suffer or suffer in order to let you know whether or not this is an impediment to enjoying the Experience and/or Service. In addition, we do not approve adding additional people to the group that has made the reservation for the Services or Experiences and we hope your help in complying with this requirement.
1.6- On the conditions for the validation of the reservation contract:
To validate a reservation, our clients must provide proof of payment and the following information:
- Full name
- Birthdate
- ID or Passport
- Address / Neighborhood / City / Zip Code
- Contact phone (preferably with WhatsApp)
- Email
- Time of entry to the property / Flight number (if by air) Time of departure from the property Name of other guests (if applicable);

Payment, Reservation, Rent and Security Deposit
To reserve one of our properties, we require a reservation confirmation deposit of 10% of the total rental amount. The rest of the rental amount will be charged 30 days before entering the property. The payment of 10% of the reservation can be made by credit card or by cash payment at our office. Your reservation will be validated as soon as the reservations department sends a confirmation email after making the reservation payment. If, for any reason beyond the control of our management, the leased property is no longer available, we offer our clients the choice of a similar property or a full refund of all amounts paid. Payment of the rest of the cleaning fee / bed linen fee, if any, must be made at the time of signing the contract and handing over the keys. The security deposit will be settled by card upon arrival (fully refundable).
2. Handling of Cancellations, Adjustments for Travel Setbacks, and conditions for Refunds and Reservation Modifications.
2.1- Cancellations, Travel Setbacks and Refunds: in general terms, you must pay the agreed amount at the time of contracting accommodation if you wish to cancel said contract or wait for the established refund amount. However, under certain circumstances we can make concessions to change the date of your trip or be more flexible with respect to the amount of the refund or payment for cancellation. If an event occurs outside of your control or capabilities, such as accidents, flight delays, or other circumstances, you may be eligible for a full or partial refund, or in other cases assistance in rescheduling your stay at a most favorable date. However, these adjustments must be accepted by both parties and to opt for a full refund, evidence may be requested from Us to support your case and thus proceed with a more flexible cancellation or refund policy and the approval of this will be always informed to you.
2.2- Regarding the modifications: The only ones responsible for the modification of a reservation are We, the Guest who has contracted the accommodation or a person duly identified and presented by you with the evidence that proves it, and only said change or modification in the reservation date if you have duly expressed your desire to do so and if We have verified the availability in the calendar of the property. It is possible that, depending on the date of the change, a surcharge will be applied to the Total Price, but this adjustment will always be duly informed to you in advance with the details duly exposed. No third party with your authorization may manage a change of date or modification to the Accommodation contract.
3. Guest Responsibility and Acceptance of responsibility under knowledge of possible Risks.
3.1- Guest Responsibilities: You and your companions will be solely responsible at all times for their own actions and their consequences, which includes additional people approved by Us to join the group and who are duly authorized to remain in Accommodation, to enjoy the Experiences or take advantage of any of the Services we offer. This implies that:
• You and the group are responsible for leaving the accommodation, keeping it in the conditions and state in which it was delivered to you at the time of check-in;
• You are responsible for responding and covering any expenses that arise from damages to the property caused by you, by the members of the group or by the pets that accompany them, as well as the due process of Claiming Damages if these damages are hidden or not reported and discovered later at check-out;
• You and your group members must always show respect to the property, the caretakers of the accommodation, the members of the neighborhood and the Hospedify team. They must always comply with the laws that govern at the national level and respect the rules of the property, which will be explained and presented in a physical or digital way to make them known to you. These rules must be followed at all times. If a minor is part of the group that accompanies them, you must be legally authorized to act on their behalf and/or ensure that, if you are not their legal guardian; The person in charge of this minor is always attentive and supervising the integrity and safety of the minor.
3.2- Assumption of Risks: Acknowledging that carrying out any activity may entail an inherent risk, You assume and are responsible for all risks involved in the use of this website and the tools we provide. This responsibility includes:
• The use of the accommodation and its spaces in an appropriate or improper manner;
• The risk of practicing any experience offered and/or requested by you or by the group;
• The use of the Services offered and the consequence of interaction with people who are not part of the group.
For this reason, we recommend that before making the reservation, analyze the list of services and amenities of the property, consider which ones could carry a risk of accidents, injuries, illnesses, disability or death, and decide if you accept this characteristic, Experience or Service, since Once the contract is accepted, you are freely and voluntarily assuming those risks and the responsibility of enjoying them.
4. About the Evaluations.
After each reservation, both we and you will have the opportunity to evaluate each other. For this reason, we ask that your evaluation be clear, objective and sincere. In addition, we ask you to maintain appropriate language at all times, avoid the use of defamatory, vulgar, offensive, discriminatory or violent terms, since the purpose of these evaluations is to know how your stay was and to learn how we can improve the way in which we offer our services and, if possible, use your review on this website. We reserve the right to decide what to do with Reviews that ignore the recommendations described above or that may be misleading.
5. Charges or Fees.
Hospedify may charge additional fees at some properties for included services, adjustments for additional guests, or charges for use of services not included in the Total Price. This does not imply that we are completely free to apply surcharges, rather it is a preliminary clarification, since any activity that implies an additional expense will be duly informed and the cost of this will be detailed so that you can decide whether to accept it or request an adjustment by refusing to use said service. Except as otherwise provided, service fees are non-refundable.
6. General Regulations of the Hospedify Platform.
6.1- The following set of rules of use applies both to the activities you carry out on this website, and to the activities that you or your group can carry out in any of our accommodations. Under no circumstances should you help or induce others to break or circumvent these rules:
• Act with integrity and respect at all times and treat all users of this website, work team at the properties and members of Hospedify in a dignified manner;
• Avoid promoting or sharing any false comments or misrepresenting the truth of any matter or situation related to stays or accommodations.
• You must not discriminate against or harass other people, either on the website or in the accommodations. No type of discrimination is accepted or tolerated by Hospedify.
• Do not attempt to illegally access, delete, attempt to circumvent technological security measures, or undermine the means used by Hospedify or the Content on this website.
• Use this website only as authorized in these terms.
• Do not try to manipulate or exercise any practice that has the purpose of altering the search algorithm of our website.
• Do not use trackers, bots, artificial intelligence or any other similar means, automated or manual; with the purpose of accessing the data on this website, collecting information or interacting with it through these means.
• Do not decompile, disassemble, decipher or attempt to reverse engineer any software or hardware used by Hospedify.
• It is prohibited to falsely represent others or pretend to be another person when making inquiries, submitting your information or making accommodation contracts.
• If you plan to use the personal information of another person, you must do so with the express and verifiable authorization of this person, following the applicable legal guidelines and authorizing Hospedify to use and process that information in accordance with our Privacy Policies.
• Do not take actions that may negatively affect or damage the proper functioning of this website.
• Do not register or use any social media username, trademark, trade name, domain, logo, or mark that could be confused with our Hospedify brand or content on this site.
• Do not encourage unapproved or illegal activities on this site.
• Do not request the scheduling or scheduling of reservations for activities or Experiences if you are not sure that you can enjoy and take advantage of them.
• Under no circumstances request prostitution services or promote this practice in our properties. Hospedify is against any type of expression, practice or management of human trafficking.
6.2- About infringements in Ads and Content: If you consider, perceive or feel that one of the Ads or part of its content represents a risk to property or to any person who can see it, please contact us immediately and, if necessary necessary, with the competent authority. If you consider that any Advertisement or Content has infringed any Rule in any way, feel free to communicate your concerns to us so that we can make the necessary adjustments or changes immediately using the contact means that you will find in the Contact Us section of this website. If your report is regarding something that happens in the properties that we offer for rent or its surroundings, we urge you to contact the authorities to attend to the situation and that you can understand that, although we can listen to you in these cases, we are not in the obligation to act unless it is a case in which it is required by law.
7. Right to Modifications.
Hospedify reserves the right to modify these Terms and Conditions of Use at any time. If changes are made to these Terms, the revised version will be posted on and updated on the date indicated in “Last Updated” at the beginning of these Terms. New users and regular users of the site will also be informed through notifications about these changes so that they can check and accept them.
8. Management of Complaints and Claims for Damages and resolution of these conflicts.
In the event that clear, supported and valid evidence is presented that you, your companion(s) or your pet(s) have caused damage to movable or immovable property, an application will be made of immediate compensation that will include the amount of the property affected and the consequential or indirect damages caused by said grievance. You will be informed immediately of the Damage Claim process so that you can have an opportunity to respond responsibly for the damage to the property and make the payment as soon as possible because, by signing the Rental Agreement of any accommodation advertised on this site, You are acknowledging and accepting Hospedify's right to attempt to collect from you and, in the event of your refusal, to take whatever action or legal remedy is available under current applicable law, including referral of the case to a collection agency or others. means of action in the legal framework against you. Therefore, when analyzing these Terms and Conditions of Use, you agree to act in good faith and, in the event of a situation similar to the one described above, to provide any information that Hospedify requests, to execute documents and to take reasonable measures in relation to Claims for damages, claims under policies or other claims related to the provision of our Services.
9. Indemnity Policy.
To the fullest extent permitted by applicable law, you agree to release, defend, indemnify and hold Hospedify harmless from and against any and all claims, liabilities, damages, losses and expenses, including without limitation reasonable legal and accounting fees, arising out of or are related in any way to:
• Failure to comply with these Terms and Conditions of Use
• Improper use of this website
• Interaction, your stay in an Accommodation, your participation in an Experience or other Service, including, without limitation, any injury, loss or damage (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of said interaction, stay, participation or use,
• Your failure, or our failure at your direction, to accurately report, collect, or remit taxes
• Your breach of any law, regulation or third party rights such as intellectual property or privacy rights.
